I have found some patriots! I do not pretend to be a lawyer, but I was curious about the Supreme Court’s decision today so I went and browsed the text. It will make your head hurt! I did find the paragraph below in the syllabus of the opinion. Note the highlighted language.
“Although the First Amendment provides that “Congress shall make no law . . . abridging the freedom of speech,” §441b’s prohibition on corporate independent expenditures is an outright ban on speech, backed by criminal sanctions. It is a ban notwithstanding the fact that a PAC created by a corporation can still speak, for a PAC is a separate association from the corporation. Because speech is an essential mechanism of democracy—it is the means to hold officials accountable to the people—political speech must prevail against laws that would suppress it by design or inadvertence.”
Their language equates political spending with political speech. The case is very similar to what we have been talking about in being able to spend money to support or criticize candidates. I am sure there will be additional guidance but it looks like the gloves are off and we can produce election communications as a nonprofit corporation. This decision has a direct impact on the Tea Party and our potential influence.
Since the ruling, Obama, Shumer, Olbermann and a raft of other socialists have condemned the ruling as Un-American, while it has received glowing praise from the constitutional conservatives like Mark Levin. Imagine, The Constitution: Un-American.
The liberals are using their normal demonizing tactics regarding big business to justify their support for the unconstitutional law.
Brace yourselves because this is not over. We will be called on to, again soon, protect our newly granted right to free speech. They have already pledged even more Draconian legislation to again tilt the political canvas so that only their "mainsteam" media will again be the only ones allowed to speak.
