If you have ever waived a pocket Constitution, worn a “Don’t Tread On Me” shirt or shouted “Taxed Enough Already” then I encourage you engage in this exercise in intellectual and constitutional honesty.

 

Write down your favorite candidate’s campaign promises and the constitutional authority (the specific enumerated power) to make those promises come true. You may be surprised at the result. And if you are surprised will you consider changing your support?  I suspect most will not.  Fidelity to the Constitution can be challenging when it conflicts with our wants and desires. 

Politicians come up with many wonderful and great ideas, many of which I may personally agree with or may think would improve our lives.  The question however is not whether we like it or really, really want it because it fits within our specific spiritual beliefs.  The only question is, is it constitutional. 

And please don’t rely on the commerce clause, the necessary and proper clause, or the supremacy clause, or the general welfare clause, doing so only exhibits an affinity for the phony constitutional analysis, mainly on the left, that has gotten us into this mess.

What Is It?  State nullification is the idea that the states can and must refuse to enforce unconstitutional federal laws.

Says Who?  Says Thomas Jefferson, among other distinguished Americans. His draft of the Kentucky Resolutions of 1798 first introduced the word “nullification” into American political life, and follow-up resolutions in 1799 employed Jefferson’s formulation that “nullification…is the rightful remedy” when the federal government reaches beyond its constitutional powers. In the Virginia Resolutions of 1798, James Madison said the states were “duty bound to resist” when the federal government violated the Constitution.

But Jefferson didn’t invent the idea. Federalist supporters of the Constitution at the Virginia ratifying convention of 1788 assured Virginians that they would be “exonerated” should the federal government attempt to impose “any supplementary condition” upon them – in other words, if it tried to exercise a power over and above the ones the states had delegated to it. Patrick Henry and later Jefferson himself elaborated on these safeguards that Virginians had been assured of at their ratifying convention.

What’s the Argument for It?  Here’s an extremely basic summary:

1) The states preceded the Union.  The Declaration of Independence speaks of “free and independent states” that “have full power to levy war, conclude peace, contract alliances, establish commerce, and to do all other acts and things which independent states may of right do.”  The British acknowledged the independence not of a single blob, but of 13 states, which they proceeded to list one by one. Article II of the Articles of Confederation says the states “retain their sovereignty, freedom, and independence”; they must have enjoyed that sovereignty in the past in order for them to “retain” it in 1781 when the Articles were officially adopted. The ratification of the Constitution was accomplished not by a single, national vote, but by the individual ratifications of the various states, each assembled in convention.

2) In the American system no government is sovereign.  The peoples of the states are the sovereigns.  It is they who apportion powers between themselves, their state governments, and the federal government.  In doing so they are not impairing their sovereignty in any way. To the contrary, they are exercising it.

3) Since the peoples of the states are the sovereigns, then when the federal government exercises a power of dubious constitutionality on a matter of great importance, it is they themselves who are the proper disputants, as they review whether their agent was intended to hold such a power.  No other arrangement makes sense.  No one asks his agent whether the agent has or should have such-and-such power.  In other words, the very nature of sovereignty, and of the American system itself, is such that the sovereigns must retain the power to restrain the agent they themselves created.  James Madison explains this clearly in the famous Virginia Report of 1800.

Why Do We Need It?

As Jefferson warned, if the federal government is allowed to hold a monopoly on determining the extent of its own powers, we have no right to be surprised when it keeps discovering new ones. If the federal government has the exclusive right to judge the extent of its own powers, it will continue to grow – regardless of elections, the separation of powers, and other much-touted limits on government power. I have heard what he stated and understand that he was pointing out things from a historical point of what has been and could be done, period. 

Reading part of a book is not good. One should read the whole, just like viewing the video instead of just snippets of micro seconds. That is very dangerous to do. I will get back with you when i have time to view it all. 

Gingrich's one on one debates with Cain, Santorum and Huntsman were very informing. Personally i am put off by Romney's and Dr. Paul's distance in not debating although i can understand with being a Congressional member his time is very much limited. 

Just as Sarah Palin has stated over and over, this vetting... the dialog must continue in great depth. We can thank Mr. Cain for his start up dialog of our whole tax system. He was the first and i believe him to be a very honorable man. 

I still believe the powers that be do not want Gingrich near the White House. Every Republican that has come out against him are the good  old boys from the Country Club of Rockerfeller Republicans who are nothing but ESTABLISHMENT Republicans, just as dangerous as the Progressives, the Progressive Democrats.

Your comment on term limits made me realize the true intent of the Founding Fathers. I will get the Joseph Story book and we need to backtrack and really look at when the so called Professional Congressional member started. Personally i think even the President is way over paid.

Another word that has morphed ... life, liberty and the pursuit of HAPPINESS. Happiness back in the day related more to the root HAP- like HAPPENSTANCE.  In 1530 it referred to Good Fortune, or Luck in Life, success in a particular affair. We are innately endowed with equal odds, what we do with that is not identical, nor are the results. But government when government gets involved- that is the beginning of the unintended consequences...

I feel the same here Roma. We have differed many times, respectful and i really admire and value your opinion as well as respect your input. 
There are a LOT of odd things happening. I had read an article that pointed out that McCain in 2008 took in a LOT of Romney people in his campaign and they are the reason that his campaign self-destructed his and Sarah Palin's efforts. It all makes sense now but i am not sure if those are really the facts, we need some sort of accountability and transparency in political campaigning. I just wish each professional sector would hold their own accountable for honor, like it use to be when you did not need a lawyer to draw up a thousand paged contract but you could do business on your word and a handshake that was honored.

I personally am fed up with ALL the PC~BS lies coming from everywhere, especially in the Press/Media and wish we had more investigative report who just reported truth and facts and let the people decide, rather than injecting their opinion or commentary as truth or fact but as it is.

We the people have not demanded the truth and the facts, from the press/media for decades now, many seem to enjoy entertainment rather than the facts.  

It is what it is... we need to return to truth and honor.
