TU: Nonprofit writes Florida law for its own program

I don't think any special interest group should be writing legislation for anything. The state has a legal department that should be taking any and all proposed laws at the state level and making sure they are written to comply with all state law and written in an air tight manner. To say the legislators do not have the ability or the people to put together "legal" legislation makes it sound like the state is run by yahoos and that just isn't true. I don't like the idea at all that any group would be writing legislation and passing it to an elected representative for him to promote in the state legislature nor do I like the idea that anyone's information (even a corporation) would be released to another entity without the express permission of the group, person or corporation. We have a right to expect our personal information safeguarded. This actually falls in line with something that surfaced in the last couple of weeks when Scott formed his committee to review all regulation that would hurt job formation and hit a road block when he found out the legislature has authorized non elected officials (appointed committee and commissions) the ability to write regulation with the force of law. I plan to attend a town hall for my representative, Lake Ray, on the 8th of September and address this as it should not have happened or be happening. My elected representative does not have a right to pass his authority as my representative to a non elected appointed person period. This also happens in Jacksonville as a couple of commissions have far more authority than they should have or is desireable in a democratic government, since the people have no voice with an appointed person............(I might also add that the agenda 21 model aims to head in this direction by getting appointed boards and commissions to totally replace elected officials so this should be fought fast and furiously).

A 2011 bill aimed at protecting a scholarship program funded by corporate donations was written by the only group that offers the scholarship program - not an elected official - and included a provision that would have given that group access to confidential tax information, according to emails and documents obtained by the Times-Union.

The legislation was signed into law on June 2 and upped the amount that companies can give to the program, from 75 to 100 percent of their corporate income tax liability. Donor companies are given a tax break for their contributions. The roughly $4,100 scholarships go to low-income students who want to attend private schools.

In Northeast Florida, 111 schools take part in the program, including 87 in Duval County, the second most of any county in the state. Nearly 3,600 students are enrolled in the program in Duval, Clay, St. Johns and Nassau counties.

Emails between the office of the bill's sponsor, state Rep. Mike Horner, R-Kissimmee, and Denise Lasher, the top lobbyist for Step Up For Students, show that on Jan. 26 the group sent to Horner a copy of the bill that it wrote. At Horner's request, it provided him a blow-by-blow breakdown of what was in the bill so he "would not embarrass myself or you, but rather properly defend this bill."

Step Up For Students is a Tampa-based nonprofit that offers the tax-credit scholarships. It is the only organization that takes part in the program.

Though the emails provide just one example of an outside group writing a bill that changes state law to its benefit, it's not unique. Most people who troll the halls of the state Capitol already know Tallahassee's dirty little secret - lobbyists, not elected officials, write many laws.

I know what you mean.  There are only just so many people who can dig far enough into the mess to come up with the culprits as it were.

I completely agree.  On the local, state and federal level, the lobbyists and special interest groups are running the show.  The scary part is that with these Superpacs, we don't even know who is behind the money.  It's hard to call someone out on being bought off when you don't know who is doing the buying.

Tamara, just because it happens all the time does not make it right.  This is not something that should be happening especially in relation to releasing private information about an organization so they can be chased down for donations.

Unfortunately, this happens all the time.  The NRA wrote the legislation that pediatricians couldn't ask parents if there was a gun in the house.  I'll bet that special interest groups write half of the crazy stuff that gets passed.
