So the Department of Justice, headed by Eric Holder, has filed its lawsuit against Arizona’s new immigration law. This is utterly absurd. Not a single soul in this country that has a lick of common sense in him or her can sit here and honestly say what Obama is doing is correct. Arizona is under an invasion, and in some cases assault, by illegal Mexican border crossings. Liberals love to claim that this law is racist to the core, and will directly hurt Hispanics in Arizona. Well pardon me for noticing, but the illegal immigration issue in Arizona is coming from Mexico which is a Hispanic country. However, Arizona’s law strictly states that law enforcement officers are not allowed to randomly ask people for ID. They are only allowed to ask for ID if the individual in question has been previously pulled over for another offense albeit running a red light, speeding, jay walking, etc…(which everyone already has to do)

What is Eric Holder’s reasoning for filing this lawsuit? From the AP: The lawsuit filed in federal court in Phoenix said the law, due to take effect July 29, usurps the federal government’s “pre-eminent authority” under the Constitution to regulate immigration. Well, it’s been pretty obvious that for the last 30 years our government has completely ignored the problems of illegal immigration. The AP also spells out why Arizona has had enough and decided to take matters into their own hands: Arizona passed the measure after years of frustration with illegal immigration, including drug trafficking, kidnappings and murders. The state is the biggest gateway into the U.S. for illegal immigration, and it’s home to an estimated 460,000 illegal immigrants. We can see nearly the exact same thing happening in the Gulf regarding the oil spill. The Gulf states have grown weary of a grotesque display of incompetence and red tape at the federal level, and have decided to take matters into their own hands for the oil spill.

The funny thing about the Arizona law is how closely it mirrors the Federal immigration law. The main difference? The law in Arizona says that it is a state crime to be in Arizona illegally. The fact that Obama and his liberal cronies are so upset over this is enough to make your head explode. They are literally telling Arizona, “You cannot defend yourself. You must bend over backwards for the illegal immigration problem because these hard working people are potential Democratic voters.” Why else do you think Obama has been reitterating clearing a “pathway for citizenship” for the 12-16 million illegals believed to be in this country?

Let’s also not forget that Obama is playing down the crime problems illegal immigration is causing in Arizona. If he was truly concerned about the immigration issue, he would let Arizona defend itself. But according to him, our borders “are more secure than they’ve ever been.” According to ABC news back in February this year, Phoenix has become number 2 in the list of kidnapping capitals of the world. The only other city to beat them? Mexico City. Whose doing the kidnapping? Grandma Rancher? Nope. Just your average illegal immigrant involved in one of Mexico’s plethora of drug cartels. You want some more illegal immigrant crime statistics that will really get your blood boiling? All of this comes from the Department of Justice back in 2007 in relation to incarcerated illegals:

In the population study of 55,322 illegal aliens, researchers found that they were arrested at least a total of 459,614 times, averaging about 8 arrests per illegal alien. Nearly all had more than 1 arrest. Thirty-eight percent (about 21,000) had between 2 and 5 arrests, 32 percent (about 18,000) had between 6 and 10 arrests, and 26 percent (about 15,000) had 11 or more arrests. Most of the arrests occurred after 1990. – (After amnesty round 1)

They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien. One arrest incident may include multiple offenses, a fact that explains why there are nearly one and half times more offenses than arrests. Almost all of these illegal aliens were arrested for more than 1 offense. Slightly more than half of the 55,322 illegal aliens had between 2 and 10 offenses.

These are part of the same group of people Obama wants to grant amnesty. Oh wait, a “pathway to citizenship”. But forget about all the crime these people commit. Because every single illegal immigrant that is here commits a crime every single day they are in this country. That crime is being here illegally (This is still the hardest concept for liberals to grasp. This is on par to not understanding that 2 is more than 1.) What about the financial burden illegals put on the states? Illegals do not pay taxes yet receive the same benefits as taxpayers. An estimate last year from Federation for American Immigration Reform (FAIR) estimated that in Arizona alone, the total cost burden of illegal immigrants in that state was around $2.7 Billion annually. Or an average afternoon’s worth of wasteful spending by Obama.

What else did FAIR come up with? “Between 40 and 50 percent of wage-loss among low-skilled Americans is due to the immigration of low-skilled workers…An estimated 1,880,000 American workers are displaced from their jobs every year by immigration; the cost for providing welfare and assistance to these Americans is over $15 billion a year.” And lastly from FAIR: Illegal aliens have cost billions of taxpayer-funded dollars for medical services. Dozens of hospitals in Texas, New Mexico Arizona, and California, have been forced to close or face bankruptcy because of federally-mandated programs requiring free emergency room services to illegal aliens. Taxpayers pay half-a-billion dollars per year incarcerating illegal alien criminals.

Granting amnesty will do nothing to stop the problem of illegal immigration. We’ve tried that already. Ronald Reagan tried to play Mr. Niceguy and granted amnesty to nearly 3 million illegals in 1986. What happened since then? Illegal immigration sky-rocketed. America is finally reaching the breaking point. According to recent Rasmussen polls, over 60% of Americans approve of Arizona’s new law AND approve a measure that would no longer allow children of illegals born in the US to become automatic citizens. Sidenote: The same polling agent has over 60% of Americans wanting to appeal a TRULY unconstitutional piece of legislation: Obamacare. Obamacare is unconstitutional because it forces individuals to enter into a contract with a private company (if you can call them that anymore) just because they are alive. This clearly violates the commerce clause in the Constitution.

I’ve said this before and I’ll say it again. There are only a few steps needed in order to control and end our illegal immigration problem. We must first seal off the border. If we can send a man to the moon, defeat the Soviet Union without firing a shot, destroy the Nazis and Japanese in WW2, then we can seal off our southern border. We must then crack down on employers who are willing to hire illegals at lower costs. Companies need to be prosecuted and hung out to dry for hiring illegal aliens. This will cut off a major incentive for illegals to cross the border. Lastly, we must cut off all benefits for illegals. If you are illegal, you will not be allowed food stamps. You will not be allowed to send your children to government schools. You will not be allowed to own or rent property. You will be allowed zero government subsidies. Only a life-threatening illness or incident will allow you to receive emergency medical treatment. After which, you will be deported. The bottom line: You are not an American citizen. You are not entitled to anything that American citizens have the sole privilege of enjoying. We welcome you with open arms, but only if you are willing to respect our laws and enter our country legally. Sincerely, your “racist-towards-Hispanics” writer.

John, you make some very good points:
1. if we allow the several and various states to choose which parts of the Constitution they either choose to enforce or adhere to, we basically say that the Constitution isn't the law of the land.

2. We are simply fooling ourselves if we believe that we are going to stop people from using drugs by outlawing them.

You are correct, legalizing drugs (as we did the drug alcohol), and ending welfare are the best solution, and what needs to be worked toward.

However as a business owner I find myself having to operate in real time rather than in a dream yet to be achieved. E-Verify and social security are unconstitutional. Yet to do away with them before reducing the size of government control, would be putting the cart before the horse. It would, in fact, give even more power to the government. Here is a very interesting article that explains:

"Of course, just as the welfare-warfare state was not constructed in 100 days, it could not be dismantled in the first 100 days of any presidency. While our goal is to reduce the size of the state as quickly as possible, we should always make sure our immediate proposals minimize social disruption and human suffering. Thus, we should not seek to abolish the social safety net overnight because that would harm those who have grown dependent on government-provided welfare. Instead, we would want to give individuals who have come to rely on the state time to prepare for the day when responsibility for providing aide is returned to those organizations best able to administer compassionate and effective help – churches and private charities."

Arizona hired expert lawyers who have succeeded before in these types of legislation. Knowing they could not win their battle by refusing welfare to illegal aliens, they went for real time solutions to protect all citizens. Granted, your solution (1 and 2) are the best solutions, but lawyers decided them to be impossible to achieve given current conditions. Arizonians can't wait for welfare to be abolished, and drugs to be legalized...people are suffering and dieing now.

E-Verify is unconstitutional. Yet as a business owner, given the current laws I must operate under, it is the only means I have of verifying that someone I am about to hire is here legally. So, I have asked representatives to keep E-Verify until we rid of the welfare state that draws many illegals here.

In other words we cannot return to the Constitution will be a gradual thing. Too many people are now dependent on welfare to suddenly cut them off especially Social Security (which is also unconstitutional.)

I do not think Arizona can wait to solve their problems with the violence they are suffering at the hands of the drug cartels. They have chosen the only legal means they can enact, given current laws. Note legal and unconstitutional are two different things these days.

The judge said they (Arizona) would have been better to have dealt with the welfare rather than enforcing the current laws. That would have been Constitutional, but illegal. They would have had little chance of winning that case.

I find it fascinating that a suit is brought stating that Arizona is "usurping the Federal governments pre-eminent authority under the Constitution to regulate immigration," when Arizona is mirroring Federal law, but no suit is being brought against San Francisco or any other sanctuary city for actually flaunting and openly opposing that same Federal law. Do they really think we are that stupid?

Thanks for posting this David.

1. In 2005 3% of those who showed up for jury duty were found to be illegal aliens which means they were registered to vote.


2. The SEIU, who is now taken over the jobs of ACORN, is working to increase those numbers so as to get Democrats elected.

3. Political leaders and the media like to fool us into believing that what Arizona is doing is a job for the federal government. According to the Heritage Foundation that is false. The Constitution says the job of the Fed in this area is (1) to secure our borders, and (2) naturalization. It is the States rights to enforce the laws.
