By now you heard of Ordinance 2012-296. The previous communications have detailed the ordinance and its specific implication. To site the Ordinance Preamble, “Whereas, the City of Jacksonville seeks to build a reputation as a welcoming community for bright and talented members of a workforce…..”; this is a suggested ordinance giving the Human Rights Council the powers to enforce the ordinance against businesses “should it be proven that they discriminate” on the basis of sexual orientation and gender identification. The original ordinance also eliminated references to the United States Constitution and laws of the State and failed to define sexual orientation and gender identification. Is this a new special class of people? It suggests that Jacksonville is an environment that is hostile to the gay/lesbian/transgender people. This suggestion has been disproven by recent two national level survey’s that document that we rank number 3 and 4 for being a friendly city and a great place to live.
This bill is in front of our city council for vote. It has met some resistance from conservatives, Tea Party, religious organizations and other First Amendment Rights organizations. The opposition stands just as firm in their beliefs that this ordinance is needed so that they are treated fairly. While there are some personal level stories as to their treatment none relate to workplace/community or housing discrimination. We know that you cannot legislate the personal behaviors of some individuals who make a choice to be hateful to another.
There is now an attempt to amend the proposed ordinance by reinstating verbiage to the US Constitution and eliminating “gender identification” and perhaps “sexual expression.” This however will not solve the issues that this ordinance in any form will create.
I ask that you email the city council members listed below and feel free to utilize any of the information presented below.
Ask yourself and your council member:
Are you willing to commit to the premise that Jacksonville is hostile to the gay/lesbian community?
Are you willing to believe that only the gay, lesbian world is creative as your message so clearly stated in the council meeting last week?
Are you willing to commit that this is the most important issue to attract business to Jacksonville?
Are you willing to lay the legal and financial burdens of this legislation at the feet of thousands of the small business owners in our city?
Are you willing to impose the so called special needs of these citizens while ignoring and removing the rights of so many others?
Are you willing to take the responsibility for the thousands of other employees who while utilizing their freedom of speech about their beliefs both personal and religious may be sued or their employer sued by someone who finds an innocent comment “offensive to them”?
Are you willing to accept the ultimate personal responsibility that comes with your support of this ordinance when it is now perfectly clear that the origin of this ordinance came FROM AN EXTERNAL SOURCE, with monies behind it being QUESTIONABLE?
Are you willing to tell the pubic the truth that this is being pushed at the NATIONAL LEVEL by those who have a much larger and destructive AGENDA?
Are you willing to be honest and know that this group of OUR CITIZENS are being used to push a much larger attack on EVERYONE’S freedoms? Specifically of SPEECH AND RELIGION?
This bill is not needed. There is no systemic discrimination.
In addition to the above questions the following information is provided for understanding.
The Ordinance:
1) Creates New and Special Rights for Homosexuals: The ordinance creates new and special rights for homosexuals by creating a new protected class and a special legal classification based upon “sexual orientation, gender identity and gender expression”.
2) Weakens Florida’s Marriage Amendment as the Union of One Man and One Woman: The ordinance like others around the country have been used to undermine and overturn state marriage laws and state constitutional amendments defining marriage as the union of one man and one woman. Gay rights activists around the country have used the collective scheme of nondiscrimination laws like this one to create a new protected class and legalize homosexual marriages in states like Vermont, Iowa, New Hampshire and Washington, DC.
3) Removes All References to the U.S. Constitution: The ordinance (unbelievably) removes all references to the “United States Constitution” in the city code and deletes all language referring to “civil rights found under the US Constitution”. The ordinance language thereby removes the rights, protections and limitations given to citizens by the highest law of the land.
4) Creates Legal Defenses for Pedophiles: The ordinances gender identity and gender expression language would allow men to be able to use women’s bathrooms (and vice versa) in “public accommodations” based upon their subjective sense of whether they are a male or female allowing for pedophiles to have a defense for using girl’s bathrooms. This shocking provision is being forced onto cities all around the country. The security and privacy of locker rooms, dressing rooms, bathrooms and other separate facilities are all compromised.
5) Creates More Lawsuits and Regulations for Businesses: The ordinance forces individual citizens, businesses and landlords in Jacksonville to be liable to be sued for money damages if they choose to not hire homosexual, transgendered, bi-sexual or gender confused persons in their small businesses, or choose not to accept similar persons as tenants in their private homes or apartments.
6) Violates Religious Freedoms- The ordinance forces Christians and other people of faith to violate their rights of conscience and good faith religious beliefs in business and employment situations and with housing decisions for private property owners.
I implore you to send a message to your city council NOW! Tell them that you oppose this ordinance in any form. Additionally, if you can get to City Hall this Tuesday for the next meeting PLEASE ATTEND.
Our physical presence makes a HUGE difference.
Send this to your list of small business owners so that they too can respond. Send it to your friends and ask them to email and support their city.
While it appears to be most important to send the message to Lori Boyer, Jim Love, Greg Anderson. Robin Lumb, Bill Bishop, Ray Holt and Dr. Johnny Gaffney a message to each member is highly effective.

Roma, as you know, you and I mix it up regularly. I don't think some of the others are used to it :). You know it isn't personal. I just don't much like the hijacking thing and you are a chronic hijacker!

Many people including me rely on you for this great information. I will post as well, the thing is that I will not engage when someone wants to challenge. I no longer care what Roma does, because she has decided what she wants to talk about is far more important that what anyone else might have posted to talk about. She has said I was trying to limit her freedom of speech a couple of times, and certainly I don't plan to do that, but I will opt off the web site and let her handle things permanently pretty soon. Then, she can have the site all to herself, and it will go back where it was the day I came on here and realized the newest thing on the site was over 2 weeks old. I tried to post some current news on pretty much all levels and spend a good bit of time staying current (and that was what I was doing before I started sharing information on the web site too), and then, enter stage left Roma who decides that any subject that takes off is ripe for switching to topic to Ron Paul and the federal reserve (and they are interchangeable and overlap tons as they do everywhere she posts the info). There is a point where you realize, she hasn't got the time or inclination to do what I was doing, but she does have to time to come in and hijack any blog that gets any attention, so I will allow her to do the work that goes with it too! I still will be informed, but I won't be wasting my time posting current news that no one pays attention to once the federal reserve and RP become the subject of the day yet again. It is to say the least extremely inconsiderate and rude, but no John, I am not mad. You have to care enough about something to get mad. I just can't see wasting my time and getting inundated with Email (and yes the "stop following is gone" so my in box is loaded with notices, and usually I can at least stop that part of it).
Jay and others. Yes I will keep you all updated on any activity with regards to the Ordinance. The best information that I have right now is that it is up for vote at a city council meeting on the 24th of July. We need to FILL THE ROOM. If I hear otherwise I will let you know. John, I agree that everyone has a right to their opinion. I never said they didn't, but every blog Roma comes on ends up being about Ron Paul and the federal reserve. It doesn't matter what subject you post about, that is the direction she takes the blog in at her earliest convenience. And then, we get miles and miles and miles of posts about her subject of choice. She doesn't post her own blogs about the issue, because when she does, no one posts anything. My Email box gets filled with notices indicating "Roma posts" until most of the time, I come in and take my self getting responses messages (there is also something wrong with the mechanism, so I get 2 to 3 for every single post). If this was the first time it happened (as I did the first time), I would just let it go, but any blog I post that gets a following and discussion of any kind, gets switched over to what Roma wants to discuss (ie Ron Paul and the federal reserve) at her earliest convenience. I understand truth is a beautiful thing, but there is a great deal going on right now, and on no other site that monitors posts would allow what she does. They just wouldn't approve the comments to be posted if they were way off subject. They wouldn't have probably posted the health care bill posts. I didn't care about that, but we are right back to Ron Paul and the federal reserve AGAIN which is where each and every blog I post goes, so I am off. Ken, based on your argument about Ron Paul, Herman Cain also could re-enter, but I think he cares enough about the country (and also doesn't have the ego Ron Paul and Obama have), so doubtful Herman would resurrect himself, because he understands it throw the election to Obama. Is that really what you want, or don't you care unless your guy wins?
I understand Roma can't get off beating the dead horse and fills each and every blog with her personal opinion even if it doesn't have a thing in the world to do with whatever is being discussed, because she has zero respect for those who post the blog, but really. The man can't win; he couldn't win in the 2008 election, and he has run and run and run and no one will elect him. Even McCain took the nomination and he was a loser piece of icky and still is, and Ron Paul couldn't take the nomination from him. Please, dear God in heaven give this up. I am sick, sick, sick of hearing Ron Paul did this and Ron Paul did that and you never quit!!! Post your own blog and draw people to it. And Jay as far as the sexual predator thing goes, I am well sure you know about what happened in San Francisco where on the last day of the "gay pride" month long celebration, the leader of the event was arrested for having child pornography, so let's don't say it ain't so. But let's say it happens in all communities and across the spectrum. So yes, there are members of the gay community that are also considered sexual predators.
Jay, this has nothing to do with changing the city to a more "modern version" (but certainly that is the approach being used..............what can be wrong with "updating us" is about as rational as calling me a racist, because I appose Obama and his policies; one has nothing to do with the other and is the rhetoric used to make uninformed people not think about losing their freedom of speech and freedom of religion and freedom of association and to make this bill sound innocuous and it isn't. It creates huge problems for small businesses and those religiously apposed to promoting this chosen life style (and that is not to say they are rude to people or cruel to them, they just use their freedom of association not to associate with them). The problem is that this who bill is so much garbage and most of us know it. What this legislation does is turn a group of people, many of whom are emotionally lit on hormones and heaven knows what other kinds of meds, to haul anyone they perceive has slighted them into the human rights council to a trial of sorts and fines or maybe worse. I mean I had a transgender who came on this site say I called them sexual predators and I never said any such thing and wouldn't, but maybe you think it would be "modern" for me to be accused of doing something I didn't do and fined for it, because a group of liberal wanna be shrinks decided in thought I felt that way when I don't. And we are doing that in a city that does not have gay discrimination and has a large group of gays that are well accepted in the communities they live in (one of the members of our group said they have at least 4 gay couples living in their community and they love them as they are good neighbors and active members of that community who keep up their homes and help out anyway they can etc). This is a slap in the face to all the various communities around Jacksonville that have no issues and who have gay couples living within them (and given the whining about not being able to get jobs, I might add that this particular community is what I would call "for the well healed" and on the higher end of the echelon price wise, so it might be safe to say, some gay folks are getting not just jobs but good paying ones). We are ranked 4 and 3 on 2 national polls about being a good place to live and a friendly place to live (and we almost tied on that one for number 2). What issue exactly, that our city has, does this bill address, and are we willing to give our city a black eye by saying we discriminate against gays when that is clearly not true. Usually legislation addresses a problem that needs a solution, and this bill does not. So let me add a little something here in addition. At one of the city council meetings, I sat next to a man who was transgender and dressed like a woman. My observation was unkept dirty long nails, unshaven legs, crumpled clothing and in general a very unkept look. If this person went looking for a job, based on their less than well groomed appearance, a person might be forced to hire them because they are gay and might not be able to not hire them based on their general appearance (and as most of us know, appearance and well groomed appearance is important when you are looking for a job).
It is my understanding if your business requires a specific uniform (say like Olive Garden) that requires white shirts and black pants for ALL employees (male and female), then, if someone shows up dressed as you described, you send them home as they are not in uniform! As far as the hair goes, there is little you can do about it, but the uniform you could!
If you're not already aware. This is what's going on in DC while dangerous criminals are allowed back out on the streets. It's horrifying that this is happening to our citizens and veterans for protesting the hijacking of our election process. This is still happening! They are STILL being tortured and treated like full on terrorists.
