Tampa Bay Online: Florida Supreme Court: Rick Scott overstepped his authority

This may be something we should weigh in on as it really is a good idea.  I don't understand how these folks should have rule making ability when it might impact employment in our state.  Should we right to our state representatives?  I think maybe so.  The TU has a short piece on this today with links, and if you follow them, you get to this article which actually has enough information to let you know what is really going on and what this is all about.

The Florida Supreme Court dealt a blow to Gov. Rick Scott on Tuesday, finding that he overstepped his constitutional authority when he suspended rulemaking by state agencies.

Ruling against Scott in favor of a low-income blind woman from South Florida, the justices said in a 5-2 opinion that Scott had violated the separation of powers between the legislative and executive branches.

Scott on Tuesday disagreed with the ruling. "I don't think it follows the Constitution. It's a disappointment."

On his first day as governor in January, Scott froze rulemaking by all executive agencies under his authority and created a new Office of Fiscal Accountability and Regulatory Reform to determine whether proposed rules might unduly burden businesses. No agency would be permitted to adopt or alter a rule without approval from the new office.

The order put on hold thousands of rules governing everything from health care to environmental protection. The accountability office was also charged with reviewing existing rules and identifying which should be repealed. Scott has constantly cited government regulation as a primary obstacle to job creation.

Did you write and tell Obama that in relaton to the amnesty bill allowing 300,000 illegal aliens to get green cards so they can compete for jobs with the millions who are out of work.  The Dream Act was voted down not once but twice that would have allowed for what this fool in the white house is doing, but he went right ahead and did it.  The only difference; however, is that what the governor did was done based on advise from attorneys and what Obama did was to thumb his nose at the congress.  And Governor Scott had good reason to believe he could determine what commissions etc did since no one that isn't an elected official should be writing any kind of regulation that has the force of law.  I personally plan to write and tell my representatives I do not appreciate them co-opting their law making ability to someone who is not an elected official.

Scott's attorney said that the governor has,  "supreme executive power". Well not really. The legislature makes the laws, and the governor ensures that his departments follow the laws. And the Supreme Court ensures that all follow the Constitution. He is governor, not king.
